When Can My Children Visit Me?

“Parent-time” is the term used to describe a noncustodial parent’s right to spend time with his or her child. Normally, the court will allow “frequent, meaningful, and continuing access” to the children. Section 30-3-35 of the Utah Code outlines the recommended minimum parent-time schedule for children ages 5 to 18. For younger children, Section 30-3-35.5 provides the recommended schedule. In addition, Section 30-3-33 includes recommended orders that judges should consider including in all custody orders to govern visitation.

Although the recommended schedules are the norm usually followed by the court, the judge can deviate from these guidelines as may be appropriate in the best interest of the children.
